Police arrest man in killing of Auburn student

(CNN) -- Police have arrested a man in the killing of Auburn University freshman Lauren Burk, who died this week, according to the Auburn, Alabama, assistant police chief.

Courtney Larrell Lockhart, 23, of Smiths, Alabama, is charged with capital murder during a kidnapping, capital murder during a robbery, and capital murder during an attempted rape, Tommy Dawson said Saturday.

The Phenix City Police Department took Lockhart into custody on Friday, police said. Phenix City is about 35 miles southeast of Auburn.

Investigators have the suspect's photo, which was enhanced with the help of NASA, Dawson said, according to The Associated Press. Dawson said the photo matched Lockhart, but he declined to say how police got the photo or why they think Lockhart is linked to the crime.

Burk, 18, from Marietta, Georgia, was found shot on North College Street, a few miles north of campus, on Tuesday night. She died later at a hospital.

Minutes after police responded to the call reporting an injured person and found Burk, they found a car -- which turned out to be Burk's -- on fire in a campus parking lot.

The university's Web site said memorial services for Burk are scheduled for Saturday and Sunday at a Marietta church and synagogue, and a campus-wide memorial service will be held Monday.

The site carried a message from Burk's father, James, which said: "The Burk family was so proud to have Lauren as an Auburn University student. We want to extend our deepest gratitude and appreciation for Auburn University, the city of Auburn and the Auburn Police Department. We feel very close to your community. We appreciate what everyone is doing for us and Lauren."

CHAPEL HILL, N.C. — North Carolina police on Saturday released two ATM surveillance pictures of a "person of interest" in the case of a slain university student and said it appeared to be a random killing.

Chapel Hill Police Chief Brian Curran, speaking at a news conference, described the pictures as "our biggest break so far" in the investigation into the death of Unversity of North Carolina student body president Eve Carson.

Police have yet to identify the person in the photos, who apparently used an ATM card belonging to Carson, a senior who was shot to death early Wednesday on a city street not far from campus.


Curran said police have circulated the pictures with police departments in North Carolina, hoping their officers can help identify the suspect. The ATM photos show a young man in a baseball cap and hooded sweat shirt driving a sport utility vehicle that may be Carson's Toyota Highlander, Curran said.

Police also released a photo of a baseball cap the suspect appears to be wearing in both of the surveillance pictures. Curran declined to say when the pictures were taken.

Carson was last seen around 1:30 a.m. Wednesday, when she stayed behind at home to study while her roommates went out for the night. She was known to work late at her campus office, and Curran has said Saturday that "she may have mentioned something about needing to print off papers later that night."

But Curran has said police don't have any evidence that she made it to her office. There were no signs of forced entry to her home and police said they are not aware of anyone who might have been angry with Carson. There are no indications she had been sexually assaulted.

TACOMA -- Seven years after the radical Earth Liberation Front firebombed the University of Washington's Center for Urban Horticulture, a federal jury on Thursday convicted the accused lookout, Briana Waters, of two counts of arson.

A former Evergreen State College student, Waters, 32, had been charged with five criminal counts, including conspiracy and use and possession of a destructive device, which could have put her behind bars for at least 35 years.

The jury deadlocked on those counts, and Waters now faces five to 20 years in prison.

Afterward, one juror said Waters' 3-year-old daughter weighed on the deliberations, which took four days. A pretty, fresh-faced violin teacher from Oakland, Calif., Waters had repeatedly referred to her daughter, Kalliope, when testifying that she did not help plan the fire and was not at the crime scene.

"It was clearly emotional," said the juror, who declined to give his name. "At the time (of the crime), she didn't have a daughter, but now she does."

Prosecutors said the burning of the research center was part of a six-year arson rampage by regional members of ELF and another group, the Animal Liberation Front. Their fires, which began in 1996, caused $20 million in damage, destroying a Colorado ski resort, sport utility vehicles and genetic engineering labs.

Of the five people charged in the UW fire, Waters was the only person to stand trial. Two defendants pleaded guilty and testified against her for reduced sentences. Another became a fugitive. The fourth killed himself soon after he was arrested.

Detectives in three states on Thursday were hunting for clues in the mysterious shooting murders — a day apart — of two college coeds from Georgia, and sources have told FOX News that an arrest may be imminent in one of the killings.

Police in Auburn, Ala., said Thursday afternoon they are pursuing promising leads as they try to identify who killed 18-year-old Auburn University freshman Lauren A. Burk of Marietta on Tuesday night near campus.

Local reporters told FOX News' Greta Van Susteren Thursday evening that authorities are said to be close to an arrest, though no suspects have been named.

WBRC's Dave Bondy told Van Susteren that Lee County Sheriff Jay Jones had said investigators are investigating the possibility Burk knew her attacker, but the sheriff wouldn't say whether police had confirmed that detail.

Burk was found with a single gunshot wound to the head around 9 p.m. Tuesday on Alabama Highway 147, three miles off campus. Police said her Honda Civic was discovered 20 minutes later engulfed in flames at the campus.

Carson, of Athens, Ga., died from multiple bullet wounds, including one to the head. After responding to reports of gunfire, police discovered Carson lying dead in an intersection in a Chapel Hill residential neighborhood close to the university.

TACOMA -- Randi Miller was sitting on her bed. Her husband, Timothy Miller, was in the shower when they both were shot to death Saturday night inside their Parkland home, according to court papers filed Monday in Pierce County Superior Court.

The 22-year-old woman now held on suspicion of aggravated murder and kidnapping -- of the couple's 6-month-old girl -- left the Millers' home after the shooting, bought muriatic acid at Home Depot and returned, the affidavit of probable cause said. She tried but failed to destroy the bodies in a bathtub, a court affidavit said.

The suspect, Spc. Ivette Gonzalez Davila, a member of Fort Lewis' I Corps color guard, shackled and dressed in an orange Pierce County Jail inmate's uniform, appeared at a preliminary bail hearing before Superior Court Judge Ronald Culpepper on Monday. Davila is to be arraigned Wednesday afternoon.

Culpepper ordered Davila held without bond for investigation of aggravated first-degree murder in the deaths of the Millers, who also were active duty Fort Lewis soldiers, and the kidnapping of their baby. Timothy Miller, 27, of Nevada and Randi Miller, 25, who was believed to be from the East Coast, served at the post's Madigan Army Medical Center.

Investigators Say Family Opposition to Boyfriend

May Be Behind Brutal Texas Murders

ALBA, Texas — Investigators say a bloody attack on a rural East Texas family's home may have resulted from family opposition to a daughter's boyfriend.

Rains County Sheriff department confirmed Sunday a 16-year-old girl is one of four suspects being held for the violent murders of her mother and two brothers.

The girl, whose name is being withheld due to her age, is the girlfriend of one of the suspects, investigators revealed. Neighbors told MyFOXDFW.com that the girl's parents, Terry and Penny Caffey, were trying to break up the couple.

The teen was found by police early Sunday hiding at the home of one of the suspects, although it was not clear from the police account which of them she was dating or where she has been hiding.

The four suspects, which include the unidentified teen, 19-year-old Charlie James Wilkinson, 18-year-old Bobbi Gale Johnson and Charles Allen Wade, 20, went before the Justice of the Peace and were formally charged Sunday morning with three counts of capital murder each, police said. All remained in Rains County Jail with bonds set at $1.5 million.

The scene of the attack was about 20 acres of pine-canopied, remote woodland on a narrow gravel road with just two other homes between the small East Texas towns of Emory and Alba. That is about 60 miles northeast of Dallas in Rains County, the second-smallest county in Texas.

Mrs. Caffey, 37, was killed along with her two sons, Tyler Caffey, 8, and Mathew Caffey 13, according to police. All had been shot and stabbed multiple times. Terry Caffey was in critical but stable condition Sunday in East Texas Medical Center in Tyler, where he was being treated for a gunshot wound to the head.

ATLANTA (AP) — The rap star Juvenile is "shocked and devastated" by the shooting death of his young daughter, the girl's mother and another child, his manager said Saturday.

The 32-year-old rapper is still trying to cope with the death of 4-year-old Jelani; her mother, 39-year-old Joy Deleston; and the woman's daughter Micaiah, 11, whose bodies were found Thursday night in their home, said manager Aubrey Francis.

"It really shocked him and devastated him to the point where I've never seen him before," Francis said. "Right now he is relaxing and trying to grasp everything of what has happened."

Meanwhile, 17-year-old Anthony Tyrone Terrell Jr. is being held in the DeKalb County jail, charged in the deaths of his mother — a Gwinnett County sheriff's deputy — and siblings at the home near Lawrenceville, outside Atlanta. He was arrested Friday.

Deleston brought a paternity lawsuit in 2004, claiming that Juvenile, whose real name is Terius Gray, was Jelani's father, Gwinnett County court records show. Both parties later agreed Juvenile was the father.

Because of his age, prosecutors cannot seek the death penalty against Terrell. A preliminary hearing will be set next week in Gwinnett County Superior Court, prosecutor Danny Porter said.

LAWRENCEVILLE, Ga. — The 17-year-old boy was arrested Friday and charged with killing his mother, who was a sheriff's deputy, and his two small sisters, authorities said.

Anthony Tyrone Terrell Jr. was charged with murder in the shooting deaths at the family home near Lawrenceville, where the bodies were found late Thursday, said police spokeswoman Illana Spellman. She identified the victims as Gwinnett County Sheriff's Deputy Joy Deleston, 39, and her two daughters, Micaiah, 11, and Jelani, 4.

The motive for the killings was still under investigation, Spellman said.

Terrell was taken to jail in neighboring DeKalb County to avoid any potential conflict because Deleston worked for Gwinnett County, Spellman said. He is being held without bail.

Spellman said she could not confirm whether Deleston's service weapon was used in the fatal shootings or if investigators recovered the gun used in the killings. She said she did not know if there were any prior police calls to the home.

TV re-enactment nets 100 tips in Boca mall slayings

The gripping re-enactments of three crimes centered at the Town Center mall yielded 100 tips after Saturday's airing on America's Most Wanted, police said Monday.

The half-hour segment was dedicated to the slayings of Randi Gorenberg and of Nancy Bochicchio and Joey Bochicchio-Hauser. The show's host, John Walsh, also interviewed the 30-year-old mother who was carjacked by the man some believe committed all three crimes. The woman, whose identity was hidden, provided a description used to sketch the suspect.

Officer Sandra Boonenberg, of the Boca Raton Police Department said the tips came through the TV show, Crime Stoppers and the department's tip line. She could not say immediately how valuable the tips will be toward capturing a suspect.

"Every tip was passed onto the investigators for follow-up," said Avery Mann, a show spokesman. "Clearly, this case is important to our South Florida viewers."

Gorenberg, 52, was killed in March and left at Gov. Lawton Chiles Memorial Park west of Delray Beach. About 40 minutes earlier, surveillance cameras caught her leaving Town Center at Boca Raton.

Bochicchio, 47, and her 7-year-old daughter were abducted in December after leaving the mall and were forced to withdraw $500 from an ATM. They were bound and covered with darkened sunglasses and goggles like the woman who escaped the August carjacking from the mall.

A man stabbed to death early Thursday has been identified as 29-year-old William F. Ball -- a convicted felon who was briefly a person of interest and later cleared in the New Year's Eve slaying of Capitol Hill resident Shannon Harps.

Ball's body was found face down just before midnight Thursday on a driveway in the 10300 block of Greenwood Avenue North. He had been stabbed once in the left side of the chest, Seattle police said.

A man who lived nearby called 911 after hearing what sounded like a body hitting the ground. He looked out to see Ball near a pool of blood, police said.

Ball struck the concrete with such force that some of his teeth were dislodged and remained in the driveway hours after he died at Harborview Medical Center.

Detectives were investigating Thursday, and police said they did not have a suspect or motive and had not found the weapon.

It was still unclear Thursday how Ball got to the homicide scene. Police were trying to determine whether he was thrown from a moving vehicle onto the concrete. A driver had reported seeing him on the ground shortly before midnight.

Police, who were called by firefighters at 12:01 a.m. Thursday to where Ball's body was found, said CPR was performed, but he could not be revived.

RENO, Nevada (CNN) -- Candles illuminated the somber faces of hundreds of people who gathered Friday night near the University of Nevada-Reno for a vigil to remember slain college student Brianna Denison.

Students who never knew her joined Denison's friends at the spot on an empty field where her body was found a week earlier 10 miles from the school.

Handwritten posters said "We love you Bri" and "Shine on us Bri."

One of the speakers urged the community to stay vigilant and safe.

"For a brief moment in time, a beautiful young woman graced us with her presence," said Marc Klaas, whose daughter was kidnapped and murdered in 1993.

"But from now on, for all eternity, Reno, Nevada, will have an angel sitting on God's shoulder looking out for your children."

The horror and fear began on a cold winter night last month. A stranger apparently walked into an off-campus house and abducted the sleeping Denison.

She attended Santa Barbara City College in California, but had returned to her hometown of Reno to spend time with friends and family.

CHICAGO — The death of the third wife of former police officer Drew Peterson has been officially declared a homicide after another autopsy revealed she drowned, the Will County state's attorney said Thursday.

The second report on Kathleen Savio's March 2004 death included photos from the scene and reports from the initial investigation, along with results from microscopic examinations and toxicological tests, Will County State's Attorney James Glasgow said in a statement.

"We have been investigating this as a murder since reopening the case in November of last year," Glasgow said. "We now have a scientific basis to formally and publicly classify it as such."

Savio, 40, was found dead in her bathtub shortly before her divorce settlement with Peterson was finalized.

A coroner's jury ruled after the first autopsy that her death was accidental, but her body was exhumed last Nov. 13 after Peterson was named a suspect in the disappearance of his fourth wife, Stacy Peterson. She has not been found, but Drew Peterson said she ran off with another man.

Drew Peterson told the (Joliet) Herald-News on Thursday that the results "shocked" him. "You're kidding me. Unbelievable. That's hard to believe," said Peterson, 54, a former sergeant with the Bolingbrook Police Department.

Peterson has denied any involvement in either case and he has not been charged with wrongdoing. His attorney did not immediately return a telephone call Thursday from The Associated Press.

Authorities were not prepared to name a suspect, said Charles Pelkie, a spokesman for Glasgow's office.

"The investigation continues at this point," Pelkie said. "We've got an active grand jury investigation, we've got an active state police investigation."

Savio's family members, who received the news from Illinois State Police on Thursday, were not surprised.

RENO, Nev. – Somber but determined volunteers Monday assembled small bundles of blue ribbons in memory of a young Reno woman while they made up new signs to be spread around the community seeking help in finding the serial rapist who killed her.

Blue was Brianna Denison's favorite color. Operating from a large fifth-floor office at Saint Mary's Regional Medical Center, about a dozen volunteers tied ribbons and heaped them on a table – making them available to anyone who stopped by.

At another table, workers made signs that read, “Bring Bri Justice.”

“Today's a day to get reorganized,” said Claudette Springmeyer, a spokeswoman for the small army of volunteers that has numbered close to 1,500 in the days and weeks since Jan. 20, when Denison, 19, was kidnapped while sleeping on a couch at a friend's rented home near the University of Nevada, Reno

Based on the previous sexual assaults, police described the suspect as a white man, 28 to 40 years old, with a long face and square jaw. He is 5-foot-6 to 6-feet tall, of slight or medium build, with brown hair. Authorities said his pubic region was shaved.

His vehicle was described as a high, extended cab pickup or SUV with an exterior step up into the cab. The vehicle also had an interior dome light above the windshield, cloth seats, a narrow floor-mounted console, and a radio with a blue and red LED read-out.

RENO, Nev. (AP) — A 19-year-old college student missing since she was abducted nearly a month ago was strangled by a serial rapist who has attacked at least two other women and may strike again, Reno police said Saturday.

An autopsy confirmed that a dead woman found Friday in a brush-covered field near a business park was Brianna Denison and that she died of strangulation, Reno Deputy Police Chief Jim Johns said.

Her body had been in the field for more than a week about 8 miles from the house where she last was seen early Jan. 20 at the edge of the University of Nevada, Reno, he said.

"I would say this is a serial rapist," Johns said at a news conference. "We have two, probably three (cases) linked through DNA."

"The totality of the information in this case leads us to believe it is a sexually motivated crime," he said. "I'm worried this guy is still out there, and I'm worried somebody else is going to get hurt."

Campus officers will do all they can to support investigators "in hunting this animal down and bringing him to justice," said university Police Chief Adam Garcia.

Heavy snowfall over the past few weeks may have delayed the discovery of her body, police said.

Denison was abducted by a suspected rapist that police have linked by DNA to a string of attacks near the Reno campus. A student at Santa Barbara City College in California, she was visiting her hometown over winter break and was last seen sleeping on a couch at a friend's rental house just off campus.

DNA evidence links Denison's kidnapping to two other attacks on women near the university late last year, police said, and an earlier campus attack also could be related.

In that earlier incident, the attacker brazenly raped a woman at gunpoint in a garage where campus police park their cruisers.

Based on partial descriptions from previous victims, police have described the suspect as a white male between ages 28 and 40 and at least 5 feet 6, with a long face and brown hair. He was believed to have no accent or regional dialect.

NEW YORK (Feb. 16) - A Queens man with a history of mental problems was arrested Saturday in the vicious slaying of a psychologist attacked in her office with a meat cleaver, police said.

David Tarloff, 39, was taken into custody in the morning after investigators matched him with three palm prints found at the bloody crime scene, said Police Commissioner Raymond Kelly.

Tarloff made statements incriminating himself during a 25-minute interrogation, Kelly said. The questioning stopped when he asked for a lawyer, and it wasn't clear later Saturday whether he had an attorney. Murder and attempted murder charges are pending, Kelly said.

Therapist Kathryn Faughey was slashed 15 times with the cleaver and a 9-inch knife in her Manhattan office Tuesday evening. A psychiatrist who worked in the building, Dr. Kent Shinbach, went to Faughey's aid and was badly injured.

During questioning, Tarloff said he had gone to the office because Shinbach had him institutionalized in 1991. He said he planned to rob the psychiatrist and leave the country with his mother, who lives in a nursing home, but until recently had lived with him in an apartment in Queens.

Sisters Betty and Margaret Feeney, who live below Tarloff, said they have known him his entire life. They described him as unstable but were shocked that he was accused in the slaying."I know he's crazy and everything," said Betty, 72. "I don't think that he's capable of doing something like that - of killing somebody. I really don't."

She said that Tarloff would come around asking for money but that she would not give it to him."

I would keep out of the elevator if I saw him. I was scared of him. I wouldn't go near where he would be," she said. "He used to make terrible noise above us. We had an awful time with him. He was tramping back and forth all hours of the night."

Bobby Cutts Jr. Found Guilty of Killing Pregnant Girlfriend and Fetus, Mistrial Request Denied

CANTON, Ohio — A former police officer who tearfully told jurors he accidentally killed his pregnant lover was convicted Friday of murdering her and their unborn child.

Bobby Cutts Jr. could face the death penalty. He had claimed he accidentally killed Jessie Davis by putting an elbow to her throat, then panicked.

Cutts, 30, was convicted of aggravated murder in the death of the nearly full-term female fetus, which carries the possible death penalty. Jurors will return later this month to weigh a sentencing recommendation.

Jurors reached their decision on their fourth day of deliberations. Cutts sat with his hands on his lap and held his head erect without emotion as the verdicts were read.

Prosecutors told the jury that Cutts killed Davis, 26, last June at her Lake Township home to get out of child support payments for a fourth child.

The couple's 2 1/2-year-old son, Blake, who was found home alone, gave investigators their first clues to his mother's disappearance when he said, "Mommy's crying. Mommy broke the table. Mommy's in the rug," and, later, "Daddy's mad."

For more than a week, Cutts, then an officer on the Canton police force, denied knowledge of her whereabouts as thousands searched in the area. He finally led authorities to the body, wrapped in a comforter and dumped in a park about 20 miles from her home.

Cutts testified for four hours Monday, saying tearfully that he accidentally killed Davis as he was trying to leave her house and she didn't want him to go. He said he then panicked.

5 shot dead, including gunman, at Northern Illinois University

DEKALB, Illinois (CNN) -- A gunman dressed in black walked from behind a curtain at the front of a large lecture hall Thursday at Northern Illinois University and shot 22 people, four fatally, then killed himself, authorities said.

Seventeen victims were taken to Kishwaukee Community Hospital, its Web site said.

Of those, six were in critical condition and were flown to other hospitals. One fatality, a male, was confirmed -- but was not the gunman, the hospital said. Two were admitted, and three others were discharged. The other five were not addressed on the Web site.

Most of the injuries are head and chest gunshot wounds, a spokeswoman tells CNN.

The shooting occurred shortly after 3 p.m. (4 p.m. ET) in Cole Hall. The class runs from 2 p.m. until 3:15 p.m., university President John Peters said.

"It started and it stopped very quickly," said Police Chief Donald Grady. The gunman, whose identity has not been revealed publicly, was not a student at the NIU campus in DeKalb, west of Chicago, but "may have been a student somewhere else."

Police do not have an apparent motive now, Grady said.

Kevin McEnery said he was in the classroom when a man dressed in a black shirt, dark pants and black hat burst in carrying a shotgun.

"He just kicked the door open, just started shooting," said McEnery, who was in the class at the time. "All I really heard was just people screaming, yelling 'get out.' ... Close to 30 shots were fired."

There are about 162 registered students in the class that met in the large lecture hall.

"Witnesses say someone dressed in black came out from behind a screen in the front of the classroom and opened fire with a shotgun," Peters said.

The gunman fired from a stage at the front of the classroom, Grady said.

BRENTWOOD, New Hampshire (AP) -- The gunman in the notorious Pamela Smart murder case has been denied early release from prison, but he will be eligible for parole three years earlier than he previously would have been.

William Flynn, 33, was 16 in 1990 when he shot Smart's husband in the couple's condominium.
He said he killed Smart at the behest of his wife, Pamela Smart, a media coordinator at Flynn's high school who had seduced him and was threatening to break off their affair.

Judge Kenneth McHugh, in an order released Tuesday, found that 18 years in prison for the murder wasn't enough.

McHugh wrote that after hearing the expressions of hurt and anger from the Smart family at Flynn's hearing last month, the court suspects that even Flynn "in the deep recesses of his soul would agree."

McHugh ruled that Flynn could become eligible for parole after he had served 25 years in prison, three years sooner than he would have under the 28 years-to-life prison sentence he is serving. Flynn had asked to be released now because he has spent more than half his life behind bars.

Flynn will have served 25 years in prison on June 4, 2015, when he is 41, according to Susan Morrell, senior assistant attorney general.
